This is further to your email below to Marc Kielburger. Thank you for copying me on the
message since, as you know, I am counsel to WE Charity, its related entities, and their
principals. In future, please direct your inquiries to me, rather than to my clients.
The recording in your possession was illegally obtained and you are in possession of stolen
property which you have no right to possess or use.
By way of background, In 2017 WE Charity conducted a spot check of operations and financials
in Kenya. It identified irregularities. An investigation was launched immediately under the
direction of a special sub-committee of the WE Charity Board of Directors. External experts
specializing in investigations of fraud and attempted theft were retained, including the African
fraud specialists Compol and Canadian cyber fraud specialists Herjavec Group among others.
All information stemming from this work was referred to Kenyan authorities. Attached is a
redacted copy of the report of Compol into the conduct of Mr. Ruhui.
As a result of the investigation the employment of Peter Ruhui and Santai Kimakeke were
terminated, and they were charged by the Kenyan police with crimes including theft, fraud,
forgery, extortion and other serious matters, with further investigations ongoing. Both individuals
signed witnessed confessions, and investigators determined that all WE Charity funds were
returned. This matter is before the Kenyan courts.
In all respects, clear protocols were followed and Kenyan police were involved.
The recording in your possession relates to ongoing criminal proceedings and investigations in
Kenya involving Mr. Ruhui and Mr. Kimkake. The police investigations were ongoing at the time
of the telephone call, the recording of which you have a copy, was initiated at the request of the
police and was taped at the request of the police as part of their investigation.
As you can tell from the recording, Mr. Kielburger was deliberately encouraging Mr. Ruhui to
continue to speak in an effort to collect information for the police. Mr. Ruhui has been criminally
charged on multiple separate criminal counts and the case is before the courts.
As we have previously advised you, Mr. Kimkake is also facing criminal charges and is the
subject of ongoing criminal investigations. His signed a witnessed confession, a copy of which
we have previously provided to you and which is attached for ease of reference, which destroys
his credibility and constitutes a full impeachment of the content of his defamatory website.
Because of the ongoing criminal proceedings and investigations involving Mr. Ruhui and Mr.
KimkakeI I have advised my clients against speaking with you directly concerning the matters
disclosed on the stolen tape so as to avoid compromising the on-going criminal proceedings. I

 would suggest to you that the public interest in protecting the integrity of police investigation far
outweighs the public interest in the publication of the stolen recording.
I must advise you that publication of illegally obtained information that is subject to ongoing legal
prosecutions and/or the knowing promotion of false claims by Canadaland against my clients
may open you up to further legal action.
