JASON (38941) Date/Time 09-14-2014 Subject USE OF FORCE On September 14th, 2014 was assigned to North Precinct as a patrol sergeant. I was in uniform, with badge displayed, driving a marked police car. Around 0007 hours I heard dispatch send officers to a call of a disturbance in the area of N. Philadelphia and N. Ivanhoe, with several people fighting or arguing. The caller reported hearing someone say the word "shot." A short time later another caller reported the same disturbance and reported hearing someone say they were going to kill someone. I began to head towards the call. While en-route I heard a Multnomah County Sheriff's Deputy, who had a DUll prisoner, advise that he was at the traffic division (old North Precinct) and could see several males in the street engaging in a disturbance. I arrived on-scene a short time later and saw Ofc. Jimenez and Ofc. Sutton detaining a subject near the corner of N. Philadelphia and N. Ivanhoe. I could also see Ofc. Hornstein and Ofc. Hughes struggling to place another subject into custody. They were standing on the east sidewalk of N. Philadelphia about 50 feet north of Ofc. Jimenez and Ofc. Sutton. The subject they were struggling with would later be identified as? I also saw a large crowd of 20 to 30 people in the area. As I pulled up I could see-had his hands clasped together in front of his stomach, intentionally preventing Ofc. Hornstein and Ofc. Hughes, who were standing on either side of him, from getting his hands behind his back. As they struggled to pull his hands apart I could see _forcefu ly pulling his arms away from them and actively resisting arrest. After getting out of my car I went to assist them but saw two subjects, one later identi?ed as quickly approaching Ofc. Hornstein and Ofc. Hughes. They were being verbally hostile and questioning why- was being arrested. They got within about 8 feet of the of?cers and I immediately ordered them to back up and move away from the officers. I noticed the other subject with_ appeared to be using a cell phone to ?lm the incident. However, it was clear to me their intent was not to simply be witness bystanders, but was to interject their objections and interfere with the officers, if not physically at least by distraction. This is a huge danger for officers who are struggling with a suspect. Officers are then forced to divide their attention between the suspect they are fighting with and other subjects who pose an unknown threat to them. Physical interference to include assaulting officers has happened and is a real threat. did not comply with my order to move back and continued to walk towards the officers. repeated by order several times and when he failed to comply I walked up to him and placed my open left palm to the center of his chest to move him backwards. At this time I had probable cause to arrest_ for Interfering with a peace officer for his failure to comply with my lawful order to back up. City code 14C.30.010 gives me the authority to restrict access to public areas and my request of_ and his unknown accomplice was reasonable and lawful. I later told them to add the charge of Interfering with a peace of?cer reference his failure to comply with my orders. After walking?back about five feet, I looked back and saw Ofc. Hornstein and Ofc. Hughes now trying to take-to the ground. I moved to help them. They were on either side of him, trying to control his arms and pushing him downwards. As they were on either side of him, I had no good area to grab onto other than his head and took hold of his hair. -had a large afro style haircut. I know from training and experience that controlling a subjects head is an effective way to control their movements. I attempted to pull him downwards as we ended up moving towards a dirt planting area that contained a few trees. However,-violently resisted our efforts at placing him on the ground, moving his feet under him to brace himself and pulling his arms free. At one point I heard -comp ain about me pulling his hair. He looked up towards me and tried to swing his right fist towards my face. i turned away and don't believe he made contact. I again tried to pull him downwards to the ground. However, he resisted this and we ended up just moving forwards towards the bank building. At some point Ofc. Hughes disengaged and turned his attention towards_ and other subjects who were again approaching and being hostile. I would later learn that Ofc. Jimenez and Ofc. Sutton were struggling with their custody during this time, see their related report, case #14-75283. This incident had the makings of a riot. As Ofc. Hornstein and I continued to struggle with-he became more violent and I saw him place Ofc. Hornstein in a head lock. He also appeared to be trying to punch us. I remember trying to take hold of one of his hands and he in turn grabbed my left hand and pulled it under him. We eventually got him pinned up against the bank building and the plexi-glass wall next to the ATMs. I saw Ofc. Hornstein trying to deliver hand and knee strikes to-and feared one of us was going to get seriously hurt. I was also very concerned about the very hostile crowd of 20 to 30 people who had gathered around. Ofc. Hornstein had already called for code 3 cover cars to respond. I believed the use of the taser, if able to access it and if able find a spot on_body to deploy it, would likely end the ?ght. Other force options, such as pepper spray or asp, were not appropriate given the close quarters struggle. While struggling to keep -bent over at the waist accessed my taser. I told him approximately 3 times "get on the ground or you?re going to get tased." He did not comply with any of those commands and made no statements indicating he would comply. i then deployed the taser, with the probes striking just about the center of his back, with the spread being about 5 or 6 inches.- said something like "ouch" and then began to fall forward. I attempted to brace his fall and was able to do so, however, the majority of his body weight seemed to land on my right knee, causing it to hyperextend. This injury will require medical attention and as write this I have pain in my knee. Once on the ground I ordered-to put his hands behind his back or he would be tased again. -complied with my request and Ofc. Hornstein was able to put handcuffs on him. Several more officers arrived on scene about this time and monitored the hostile crowd-was treated by fire personnel who removed on of the taser probes. The other had come out on its own. I will place the taser cartridge with probes into evidence. Fire personnel indicated that heart rate was elevated and recommended he be seen at the hospital. He was transported by AMR. I advised Ofc. Hornstein to charge-with Attempt APSO for his attempt to punch me in the face and Harassment for him grabbing onto my hand and pulling it under him. NARRATIVE Author HORNSTEIN, BETSY (51737) Date/Time 09?14-2014 Subject NARRATIVE On 09/14/14, at 0006 hours, I responded to the area of Edison Willamette regarding a group of 8 or 9 individuals causing a disturbance. One Of the callers said they heard something about the word "shot." Another caller said they heard one of the members of the group saying they were going to kill someone. The description given was black males and black females. As I responded to this call I was driving a marked patrol car and I was wearing a Portland Police Bureau uniform with a metal badge displayed. After the description was broadcast, Deputy Jewell came over the North net and said he saw the group walking by PPB Traffic Division, passing Syracuse St, but I did not hear in which direction. As I was coming into the area I saw a group of four black males on Ivanhoe Philadelphia Ave. When I saw them, I was already heading south on Leavitt Ave, crossing Ivanhoe St. I broadcast that I located the group, turned around on Leavitt Ave, and headed toward the group who were now on Philadelphia Ave just north of Ivanhoe St on the east side of the street, on the sidewalk. Ofc. Hughes and Ofc. Jimenez arrived at this time as well. Ofc. Hughes stopped one of the male subject and Ofc. Jimenez and I stopped the other three subjects, one Of whom was- At this time we were stopping this group as they matched the description of the group of males who were involved in the disturbance and were in the same vicinity as where the calls were coming out Of and where Deputy Jewell had just seen the group. Ofc. Jimenez and I were investigating a possible assault and disorderly conduct and we needed to identify all Of the members of this group for our investigation. As Ofc. Jimenez and I were speaking with the group, I noticed -had started to walk away from us, toward Ofc. Hughes. I double checked with Ofc. Jimenez that we still needed to identify -and Ofc. Jimenez con?rmed. I yelled to Ofc. Hughes to "stop him." I saw Ofc. Hughes telling-to stop, but-was not stopping. Ofc. Hughes then grabbed a hold Of- right arm in an escort hold, at which time I was also running over to Ofc. Hughes to assist. I then took hold ofqrm. At this time-was able to bend both of his arms up and bring them into his body. had made two tight fists with his hand and I could feel his body tense up. Ofc. Hughes and I both told-to "relax" and "calm down." Ofc. Hughes and I were both trying to speak in a calm tone of voice in an attempt to deescalate - but-did not calm down and began yelling "fuck that!" Hughes and I decided to take _to the ground at this time. I tried to sweep _Ieft leg while holding onto his left arm and Ofc. Hughes still had? right side. Ofc. Hu hes and I were struggling to take-to the ground, and eventually we all fell to the ground. began thrashing about with his arms and legs. I decided to deliver a knee strike to _body in hopes that it would knock the wind out of him and take him out of the fight that was now ensuing-was still driving hard against us, and was getting up to his feet. I then delivered approximately 3 or 4 punches to _body, still trying to stop _from fighting with us. I realized that at this time the strikes were not being very effective as I could not gain enough momentum to deliver the power to my strikes so I changed my tactic. I saw one of-Iegs, lowered myself and body position, wrapped up one of his legs with both of my arms, and began to lift- off the ground to take him off balance. As I was doing this I felt _wrap his arm around my throat and it was beginning to get tighter. I was now in fear that-was trying to strangle me, and if successful, he could place himself at a great advantage to cause me harm, and potentially render me unconscious. was able to slip out of_ho d of my throat and again delivered 3 or four punches to_body. Because of the close quarters in which we were fighting, it did not appear these punches were very effective as was still not able to gain enough momentum behind the punches being delivered. By now, we had traveled approximately 15 feet from where the first physical contact was made between?Ofc. Hughes, and myself. I also realized at this time that Sgt. Lile was also fighting with and Ofc. Hughes was no longer in the fight. _was still thrashing about, kicking, and now throwing wild punches at Sgt. Lile and me. Sgt. Lile and now were trying to pin-up against a brick wall and the thick glass that provides shelter to an ATM. As we were doing so-had again wrapped his arm around my throat, and was trying to place me in another choke hold. I also felt-rab my hair and pull it. was able to escape-hold around my throat. At some point _had punched me in the face, just under my right eye. I noticed-body was lower to the ground at this time then it had been previously, and his body was now a good target for knee strikes. I delivered 2 more knee strikes to - body. This time, it appeared to have somewhat slowed down- but he was still relentless in trying to ?ght with Sgt. Lile and me. Sgt. Lile and I had _somewhat held against the ATM shelter and the brick building. Because _was still fighting, prolonging the danger of causing injury to myself, Sgt. Lile, and - determined a taser would now be an appropriate tool to use to try to stop- I told - "you're going to get tased!" and as I pulled out my taser, I noticed Sgt. Lile had his taser out as well. I said at least one more time "you're going to get tased!" and began putting my taser away as it was clear to me that Sgt. Lile had a better position and target to tase-from. I also overheard Sgt. Lile warn-several times that-was going to get tased, but did not stop fighting. Sgt. It was clear to me that-had given up and was done fighting with us. I was able to placed-n handcuffs without further incident. I had to cut the straps of_backpack to take the backpack off of him. The distance traveled from where the physical altercation began and ended with -was approximately 20 feet. I did not try to deploy a taser earlier in the fight with-as I would have lost the physical control of-that I had. Also,-was moving too much and there was a high likelihood that I could have tased Sgt. Lile instead. I did not deploy pepper spray as the spray would have not only potentially affected- but it would have affected myself, Ofc. Hughes, and Sgt. Lile, placing ourselves at greater risk of being harmed during this incident. I inventoried-person and -was placed in the back of a patrol car, with the door open and I stood by. Portland Fire was called to check -and to remove taser probes. As -was being tended to, I noticed my knuckle on my right middle finger was bleeding and stung. I also now felt a throbbing pain under my right where I was punched. I could feel that both of my knees had abrasions on them and when I lifted my pant legs, I could see scrapes on both of my knees. My right knee had a throbbing pain and it felt as if it was beginning to swell. While -was sitting the back back of the car, asked -for his name-said don't wanna fucking talk to you" and refused to tell me his name-stood up at one point, so I put my hand on his shoulder and pressed down so that he would sit back down in my car.-then threatened to bite me if I "pushed" him again. Portland Fire informed me that-would need to go to the hospital as his heart rate was extremely high for a 16 year old male. Prior to- being transported, Dockery, arrived on scene and was notified by Ofc. Hughes regarding what had just happened. -/vas transported by AMR to Emanuel hospital. Ofc. Temple and Ofc. Ceaser went to Emanuel hospital and took custody of-again once he was released. Ofc. Temple and Ofc. Ceaser transported-to FED for mug and prints. Ofc. Temple and Ofc. NARRATIVE Author HUGHES, DAVID (50499) Date/Time 09-14-2014 0200 Subject DISTURBANCE On 9/14/14, at approximately 0007 hours, I was dispatched to the area of 8621 North Edison Street on the report of "8 or so arguing, sounds heated, the word "shot." There was no description of the subject at this point. As I was driving to the location the Dispatcher stated another caller heard someone involved in the group say that he was about to kill someone. This caller stated the group was near "Old North Precinct." As I was arriving in the area I heard the Dispatcher give an update of "9 of them walking through the streets." The Dispatcher gave a description of black males and black females on N. Philadelphia Avenue passing North Syracuse Street. I heard Deputy Jewell with the Multnomah County Sheriffs Office state that he saw a group matching the description walking by Old North Precinct. Deputy Jewell mentioned something about the instigator being a Shirt-less black male. I was next to Old North Precinct as Officer Jimenez pointed towards North Philadelphia Avenue and North Ivanhoe Street. I drove over to the intersection and observed several kids crossing the street and walking on the sidewalk of N. Philadelphia Avenue towards North Lombard Street. I got out of the car and contacted the person while Officer's Hornstein and Jimenez contacted other members of the group. We were all wearing police uniforms and displaying badges. Our vehicles were clearly marked with "Portland Police." I identified the subject I stopped as Sam Morse. Morse had blood running down the shin of what I think was his right leg. Blood was soaked through his khaki shorts. asked Morse how the injury happened and he told me that he had tripped and fallen. I asked Morse what he had been doing but I don't recall his answer. At this time I observed a male (Later identified as_ walk away from Of?cer's Hornstein and Jimenez by Morse and I. I looked back at Officer Hornstein to see if it was okay that was walking away. I saw Officer Hornstein began walking towards -and say "Hey wait." -continued to walk away as if he did not hear Officer Hornstein. I then said, clearly. "Hey!" only a few feet from -.-continued walking so I said "Hey" louder and clapped my hands together because I thought for a moment that-may have headphones in his ears (He did nul?ied around and aggressively said, "Don't fucking clap your hands at me." I walked up to and said, "Whoa, away and I grabbed his right arm and wrist. Of?cer Hornstein grabbed -left arm. -was wearing a backpack.- demeanor and response to me indicated he may continue to not be cooperative so I attempted to remove his backpack. I wanted to remove backpack to remove the threat of him accessing any potential weapons inside it or using the backpack as a weapon. was then planning to have -sit on the ground so Officer Hornstein could finish speaking witt- However, when I went to slide -backpack off his back his arms immediately tensed and flexed close to his body. I felt how strong- was because it was difficult to get any sort of movement from his arms. I attempted to bring -arm down to his side to let the backpack come off but-resisted and pulled his arm back up to his body. I told -that he needed to relax and that I wanted to take his backpack off. -said that he did not want his backpack off. I told-that he needed to relax his arm-epeatedly said, don't like this. I don't like this." Officer Hornstein and I tried to reassure that the situation was not worth fighting over. Officer Hornstein and are both Enhanced Crisis Intervention Training (ECIT) officers and have had additional training on deescalating situations. We attempted several times to get- to relax but he did not. At this point other people began rushing up to us from across the street in the square. The people were loudly shouting "What are you doing?" One subject yelled that that he was a football player and on his way to play pro football. instructed the subjects to stand back as they were only 6 to 10 feet away. A few subjects began filming us with their cell phones. We maintained control of-but had tell the onlookers to stand back. then told me, "Okay, I?ll take my backpack off." I told -that I needed to take his backpack off and that was going to place him in handcuffs-said, "You're not putting me in handcuffs." At this time Sergeant Lile arrived and ran over to assist us. was still unable to pull-hands behind his back with just pulling his arm down. I felt that if we could put-on his stomach we could take way his leverage, put his hands behind his back, handcuff him and address the growing crowd of people. I looked at Officer Hornstein and we agreed to put-on the ground. I told-hat we were going to have him go down to the ground. As soon as I began pushing -body down he kicked his legs forward pushed back against us. I then attempted to do a full take down of -but he violently flailed and tried to break free. Sergeant Lile, Officer Hornstein and I all struggled to bring down someho_was brought down to the ground on his hands and knees. continued to flail and it seemed like he was not simply trying to break free but trying to fight us. was able to get back on his feet. I remember losing my grip on so I grabbed md the waist and attempted to pick his legs up from underneath him. I could not see what was doing with his legs and arms but he continued to violently struggle. Suddenly, Officer Lile and Officer Hornstein fell down to the ground away from me with- next to an ATM machine. I got up and began to assist the officers but noticed a large crowd running towards us. There were several people within feet of all three of us. The people were screaming at us "Pigs" and other Obscenities. Sergeant Lile's and Officer Hornstein's backs were tO the crowd. I looked over and observed Officer's Jimenez and another Officer struggling with another subject approximately twenty feet away. At this time no other officers had arrived yet to assist us. I began pushing the people back away from Sergeant Lile and Officer Hornstein and created a barrier between them and the officers. I glanced back and observed -continue to fight. I do not recall how much time elapsed before I heard the pop of a taser but I turned and observed that -had been tasered and was no longer fighting. Several officers arrived and be an assisting with the large crowd. One subject in particular, who said he wasd, was screaming at us saying "arrest me." We forced the few remaining crowd members onto the Dad's Square side of North Philadelphia Avenue. Approximately twenty minutes later I was able to get?information (Dockery Saundra) from- I called Dockery and she told me she wasjust pulling up to the scene. I contacted her and told her what was going on.?kids were not even suppose to be out at this time of night and she had been driving to the location to pick them up. I explained to-what had happened and that I would make sure she spoke with--had to be checked by medics due to being tasered and it was determined that he should go to the hospital. I then walked Dockery over to?dshe spoke with him. Dockery eventually left to go to Randall's Children's Hospital to meet On my way back to the precinct I felt a sting on my right forearm and observed an approximately two inch scratch. Multiple complainants had called in to report a group of teenagers/young adults arguing and vandalizing property. She heard a female voice shouting at a male about breaking her glasses. Rawdah then heard a male shout, "Hey, get the fuck away from the hospital." That prompted her to look outside her window because the building she lives in used to be a hospital. She saw a group of at least five people outside her window. She said they looked/sounded young, but it was too dark for her to get a good look. She saw one of the males go into her neighbors yard. She thought it looked like he was bending over to pick something up, but she could not tell if he was taking something or not. I spoke to James who told me that she heard a group of people shouting. She saw a teenage male come into her yard and grab her decorative fence and throw it into the street. When she was telling him not to mess with her fence, he called her a, "fucking bitch." She described him as being a white male with tan shorts, light hair, and no shirt. She said there were about eight people in the group. They seemed to be intoxicated. They all looked to be teenagers of different races, including white, black, and Hispanic. I spoke to Carson who told me he heard male voices arguing. He saw a group of at least ?ve males yelling at people inside of a light sedan. He thought someone might have gotten out of the sedan and continued arguing. It was too dark for him to see much more than that. He could not make out what they were arguing about, but heard the word "shot." The vehicle eventually left and the group walked off NB. Officer Ceaser spoke to-who said that she saw a group walking by and heard yelling. She heard one male, who she believed to be a white male, yell "Oh god, I'ma shoot that nigga." Of?cer Ceaser also spoke to Cowan who told him that she heard arguing and saw a group standing by a black newer model SUV parked across from her home. She saw someone in the group break the side mirror on the driver's side of the SUV, but was unsure of which individual. Officer Ceaser and I checked for a damaged vehicle. We found the iisted Toyota parked in front of 9159 Willamette Blvd. The mirror on the driver's side was in fact smashed. We knocked at the address and gave the sister of the RO a case number. Officer Ceaser and I responded to Emanuel Hospital. Officer Ceaser placed -into handcuffs, double-locking them and checking them for tightness. inventoried his personal property noting nothing of value. We transported him to FED for photographs and finger printing, then we transported him to JDH without incident. The caller stated they had heard something about someone being shot. I heard Officer Hornstein inform dispatch she found the group at that corner. When I arrived, Of?cer Hughes and Of?cer Jimenez were already on scene. I saw a young man walking away from Of?cer Hughes while Officer Hughes told him to stop. The young man kept walking away from him. I saw Officer Hughes walk over to him to try to stop him, and I saw Of?cer Hornstein run over to Of?cer Hughes to assist with whatever they were doing. I was unaware of any crimes at that point, but I saw the young man being uncooperative. I saw Of?cer Jimenez trying to control another man about a half a block away from where Officers Hornstein and Hughes were trying to control the other man. I went to where Of?cer Jimenez was to assist him. The man Officer Jimenez was trying to keep from approaching the other officers was later identi?ed as Giovanni Gurule. Giovanni was etting agitated at what was going on with the other young mam?qu I arrived with Of?cer Jimenez, I saw him grab on to Giovanni's left elbow in an attempt to control him, so I grabbed on to his right elbow. was telling Giovanni, "Calm down, man. Calm down. You have to stay here. You can't 0 over there." Giovanni was ignorning me completely. He kept trying to walk over to whereh and kept yelling at the other of?cers. While I was with Giovanni, was aware that Sergeant Lile had arrived on scene and was with Of?cers Hornstein and Hughes and their subject. I don't know what was going on with them or that contact, but I heard a taser cycle, and I saw Giovanni start to lose control. He was tensing up and screaming at the other officers. I felt we needed to control Giovanni or he would end up breaking free of us and attacking the other of?cers. I told Of?cer Jimenez, "We need to go 61 We both put Giovanni's hands behind his back, and Officer Jimenez was able to put one handcuff onto his right wrist. While he was doing that, I told Giovanni, "We are handcuf?ng you and going to put you in the back of a car to calm down." Officer Jimenez told him, "You are currently being detained." As soon as Officer Jimenez put the handcuff on his wrist, Giovanni, still screaming, yanked his arm and hand out of my grip. As I tried to regain control of his wrist and arm, he continued screaming and was making steps toward the other of?cers. I was able to regain my grasp on his arm, but I was not able to regain control of it. Of?cer Jimenez and were attempting to take Giovanni to the ground, and we were telling him "stop ?ghing!" He kept counter-acting our attempts at take downs by stepping out of them. At one point Officer Jimenez yanked him toward a nearby police car, and we were able to bend Giovanni over the hood of the car. At that point I let go of my grasp of his arm and I grabbed his head. I wrapped my left arm around his head and held onto my left arm with my right hand. I held on as tight as I could because I knew if I was able to control his head, I would be able to control the rest of his body. I head on to his head in a football-type grasp. As I was establishing my grasp on his head, I could feel him trying to get himself off of the hood of the car. He was struggling to take steps to the right, which was where all my body weight was on him. I allowed him to take steps to the right while I was applying pressure to his head and neck in a downward motion to try to get him to the ground. Eventually the three of us did fall to the ground. Because of the way I was cradling his head, my arm and wrist took the brunt of the fall and Giovanni's head was not injured. I told him, "stop fighting. We're done fighting." At that point Giovanni gave up any fight. He stopped struggling against our attempts at control, and instructed Officer Jimenez to handcuff him. He was able to do so. We assisted Giovanni to his feet and placed him into the backseat of a police car. That was about the time I realized I was bleeding from my right elbow. I had another officer clean it and bandage pain. Later on I noticed I was also in pain my left wrist, and noticed it was scraped up as well due to the fight with Giovanni. Officer Jimenez transported Giovanni to MCDC on Disorderly Conduct, Resist Arrest, and Interfering with a Police Officer charges. Please see his report for further details. NARRATIVE Author KONZCAL, SCOTT (52013) Date/Time 09-14-2014 Subject DK JUV ARR FOR DISCON self dispatched to cover several units at a call of a Disturbance at Philidelphia and Ivanhoe. According to the caller at least 8 people were arguing and there was mention of shots. The intial officers that responded encountered a hostile crowd and requested additional cover. Upon arrival I observed a larger crowd of about 25 people out on Philidelphia and Ivanhoe. Among those people was_ When I exited my police car my attention was immediately drawn to?because he was yelling above all of the other noise and commotion so loud that I was able to hear him from accross a parking lot?was holding up his middle finger on each hand and screaming repeatedly while berating Police and fire fighters at the scene. I heard ?shout numerous times in a short period of time despite the noise of police cars. fire trucks, officers and an unruly crowd. The crowd gathered around _and his actions were disrupting the peace of the neighborhood. His actions had the potential to incite others in the crowd- despite being only 17, was heavily intoxicated as were many others in the crowd. I took_ into custody for Dis Con II. He was handcuffed without incident. An inventory revealed no valuables. Due to his large size I had believed?was an adult. I learned he was 17 after arresting him. I advised Sergeant Lile of the arrest and I decided to transport AO-RAMIREZ. During this time Sgt. Lile advised me that he also had p.c. to charge with IPO. Please see Sgt. Cover Sgt. Edgecomb - #21339/On scene Supervisor 8. I was dispatched to the area of N. Philadelphia Avenue and N. Ivanhoe Street regarding a disturbance. BOEC provided us with the following information: A group of eight or so arguing sounded heated, the word "shot" was heard. Prior to my arrival I stopped by the Traf?c Division located on N. Syracuse Street and N. Burlington Avenue to speak with the Deputy who had provided dispatch with information regarding the disturbance. The Deputy told me a group of males were seen walking North bound from the location towards Lombard. The Deputy said the main aggressor appeared to be a male subject wearing shorts without a shirt. Of?cer Hughes drove by the Traf?c division and I informed Of?cer Hughes about the information was told by the Deputy. Of?cer Hughes drove to the area of N. Philadelphia Avenue and N. Ivanhoe Street and I followed. Officer Hughes arrived at the location and got out of his patrol car and was Speaking with a male subject approximately ?fteen feet away from the corner of N. Philadelphia Avenue and N. Ivanhoe Street. On the coner of N. Philadelphia and N. Ivanhoe Street Of?cer Hornstein was speaking to three male subject. I stopped my patrol car and got out to assist Of?cer Hornstein with the investigation of the reported disturbanceROf?cer Horstein frisked and patted down one of the male subject. I frisked and patted down the other male subject that I contacted. I began to inquire about if anyone had seen a male subject wearing shorts with no shirt in the area. One of the male subject told me that they did not see anyone matching the description and did not see what direction they went. I began to ask one of the male subject in the group their information. One of the male subject, later identi?ed as (UF) Gurule, began to give me his information. Gurule told me he had an Identification card, so I asked him if I could see it. Gurule began to check to his pants pocket. Gurule them told me, don't have it." Since Gurule did not have his Identification card, I asked him to spell his name for me. Of?cer Hornstein asked me if I wanted to speak to with him. I told Of?cer Hornstein. "Yes". While the male subject was walking away, I gave the male suject a lawful order to stop. The male subject ignored my commands and he continued to walk away towards Of?cer Hughes. The male subject passed Of?cer Hughes. Of?cer Hornstein followed the male subject. Gurule began to say. "What are those Of?cers doing, that's- Gurule began to walk towards the other Of?cers who were dealing with? I grabbed Gurule's left arm with my right hand to stop him from interfering with Of?cer Hughes and Of?cer Hornstein. I did not grab Gurule with two hands because I was holding onto my notebook with my left hand. feared that if I dropped my notebook that it would get lost. - Sgt. Lile arrive on scene and assisted Officer Hughes and Of?cer Hornstein. I did not pay attention on what was going with? because I did not want to loose focus on Gurule. Of?cer Sutton arrived at my location to assist me with Gurule. Gurule kept insiting that he needed to 90 and help? Of?cer Sutton grabbed Gurule by his right arm to keep Gurule from approaching the other Of?cers who were dealing with- Once I saw Of?cer Sutton take control of Gurule's right arm I was able to put my notebook in my pocket. Of?cer Sutton told Gurule, "Calm down". Gurule did not listen and continued to pull towards and yell at the other Of?cers who were dealing with- I could to feel that Gurule was tensing his arm. Of?cer Sutton told me, "We need to go 61." Of?cer Sutton and I put Gurule's hands behind his back. I was able to place one handcuff on Gurule's right hand, and I told Gurule that he was being detained. Once I told Gurule that he was detained, Gurule pulled his hand out of Of?cer Sutton's grip. The hand that Gurule manage to pull out of Of?cer Sutton's grip contained the one handcuff that I had put on him. I feared that Of?cer Sutton was going to loose control of Gurule's right hand which contained the one handcuff that I put on him. I feared that if Of?cer Sutton lost control of Gurule's right hand that Gurule Would begin to swing around the handcuff on his right arm and injure Of?cer Sutton or myself. i attempted to take Gurule to the ground. but Of?cer Sutton countered my move by pulling Gurule to the ground as well in the opposite direction. Grule did not go to the ground and kept making foward movements and attempts to get his arms free from Of?cer Sutton and I. was able to get momentum and swung Gurule onto the hood of a patrol car. Gurule was bent over on top of the hood. I was able to maitain contol of his left arm. Once on the hood of the patrol car Of?cer Sutton let get go of Gurule's hand and wrapped her hands over his head. Grule continued to resist and did not stop any of his movements. It appeared that Gurule's movement carried Of?cer Sutton and I to the ground. Of?cer Sutton maintained her hold on Gurule's head. Once on the ground, Gurule calmed and stopped For JIMENEZ. I was able to get Gurule?s right hand and handcuff his left wrist. Officer Sutton and I assited Gurule to his feet and placed Gurule in a patrol car. I felt it was safer to take Gurule to the ground instead of using another foce option. EMS checked Gurule for injuries. Gurule only had scrape mark on his left shoulder. EMS placed a bandaid on his left shoulder and cleared Gurule for transport. I conducted an inventory check of Gurule's person and found no valuables. I checked Gurule?s handcuffs, double locked them, and checked for tightness. transported Gurule to MCDC where he was lodged and booked.
