SHORT TITLE. This Act may be cited as the ‘‘Secure Data Act of 5 2014’’. 6 7 8 SEC. 2. PROHIBITION ON DATA SECURITY VULNERABILITY MANDATES. (a) IN GENERAL.—Except as provided in subsection 9 (b), no agency may mandate that a manufacturer, devel10 oper, or seller of covered products design or alter the secu- ALB14753 S.L.C. 2 1 rity functions in its product or service to allow the surveil2 lance of any user of such product or service, or to allow 3 the physical search of such product, by any agency. 4 (b) EXCEPTION.—Subsection (a) shall not apply to 5 mandates authorized under the Communications Assist6 ance for Law Enforcement Act (47 U.S.C. 1001 et seq.). 7 (c) DEFINITIONS.—In this section— 8 (1) the term ‘‘agency’’ has the meaning given 9 the term in section 3502 of title 44, United States 10 Code; and 11 (2) the term ‘‘covered product’’ means any com- 12 puter hardware, computer software, or electronic de- 13 vice that is made available to the general public.
