CONSUMER OPINION CORP. and OPINION CORP., Defendants. / DECLARATION OF JENNIFER SCHAIVE IN SUPPORT OF OPINION CORP.’S MOTION FOR A TEMPORARY RESTRAINING ORDER I, Jennifer Schaive, having personal knowledge of the matters set forth herein and being competent to testify about them if called to do so at trial, state as follows: 1. I am a former customer of Roca Labs, and have first hand knowledge of the facts contained herein. 2. I purchased the Roca product online in May 2014. I was hoping the product would help me use weight. 3. I purchased the product for approximately $600. 4. I attempted to use the product for approximately one week, before deciding that it was impossible to consume. 5. I contacted Roca’s customer service, but was told that I would not be allowed to return the product. 6. Because of Roca’s terrible customer service responding to a terrible product, I filed a complaint with the Better Business Bureau. 7. On May 21, 2014, Roca contacted me regarding my BBB complaint, and said that they would sue me if I did not remove my complaint. 8. The following month, I was informed by the BBB that my complaint has been closed. 9. I provided a declaration in support of Opinion Corp.’s Opposition to Plaintiff’s Motion for Preliminary Injunction, stating those facts. ECF 13-3. On Monday, September 22, 2014, at 5:20 a.m., I received an e-mail from Paul Berger, Esq., attorney for Roca Labs, entitled “FINAL NOTICE OF BREACH OF CONTRACT” threatening a lawsuit against me. 11. Immediately after receiving the e-mail from Paul Berger, I forwarded the e-mail to Marc Randazza. 12. A true and correct copy of that e-mail is attached as Exhibit 1. 13. I believe that Roca only sent me the “FINAL NOTICE” because I gave a statement against them in this case. 14. I am afraid that Roca will follow through on their threat of litigation. 15. I believe that the public needs to be aware of all of the reviews of this company and its product, positive and negative, in order to make informed decisions. When I purchased the product, there were virtually no negative reviews online. I believed I was buying an effective product from a good company, but I was not. I would like to warn anyone else about my experiences with Roca, so they can make informed decisions. But I am afraid that Roca will sue me for stating my opinion. I  would  be  happy  to  speak  with  your  attorney  should  you  elect  to  retain  legal  counsel.    However,  should  you  not take  action  to  cure  your  breach  by  4:00  p.m.  today,  we  will  take  all  necessary  and  appropriate  legal  action  to protect  our  rights  and  uphold  our  agreement.    Please  govern  yourself  accordingly.
