Affidavit #1 Of H. Made on September 22nd, 2014 ?9 BETWEEN: VANCOUVERBOARD OF PARKS AND RECREATION AND: BRODY WILLIAMS, ANTHONY GAUTHIER aka ANTHONY GUITAR, AUDREY SIEGL, DAN WALLACE, STELLA AUGUST, JANE DOE, JOHN DOE and OTHER UNKNOWN PERSONS DEFENDANTS AFFIDAVIT #1 OF HOWARD CHOW I, Howard Chow, of 2120 Cambie Street, Vancouver, British Columbia, SWEAR (OR AFFIRM) THAT: 1. I am an Inspector with the Vancouver Police Department and'as such have personal knowledge of the matters and facts hereinafter deposed to, except where stated to be based on information and belief, in which case I verily believe that information to be true. 2. On July 17, 2014 protestors created an encampment in Oppenheimer Park (the ?Park?). On that date a wooden lean-to type structure (the ?Long House?) was erected'in the Park. Three tents were also erected near the Long House. 3. In the days following July 17, 2014 the number of people occupying the Park grew and more tents were erected in the Park.- 4. On Monday July 21St representatives from the Musqueam First Nation, including Chief Wayne Sparrow, attended the Park appealing to the aboriginal people in the protest group in #171448 an effort to get the protestors to decamp. This was initially well received, but later the protesters refused to leave. 5. According to my review of VPD records, 1 verily believe that by July 24, 2014 the encampment had grown to approximately 45 tents in the Park. 6. According to my review of VPD records, I verily believe that by July 29, 2014 the encampment had grown to approximately 70 tents in the Park. 7. As of the date of swearing this Affidavit, the encampment has grown significantly and over 200 tents are now observed at the Park on a continuous basis. Attached and marked as Exhibit to this my Affidavit is an aerial photograph 01? the Park taken on September 6, 2014. This photograph accurately depicts the appearance of the Park on that date. 8. Since the inception of the encampment on July 17, 2014 the Park has been occupied continuously by people associated with the encampment. At the commencement of the encampment approximately 15-20 people were residing in the Park at night when it was supposed to be closed to the public between 10 pm and 6 am. The number of people residing in the Park at night when it is supposed to beclosed to the public has risen considerably and, as of the date of swearing this Affidavit, approximately 150 or more people are residing in the Park overnight. Attached and marked as Exhibit to this my Affidavit is a true copy of a Police Memorandum prepared-on September 9, 2014 detailing the condition of the Park on that date and attaching photographs of the Park. 9. As the encampment has grown in size since July, 2014, more and more incidents have occurred there that required police intervention. These have included multiple infractions of the Liquor Control and Licensing Act, by-Ilaw offences, and criminal offences including common assault, causing a diSturbar-ice, breach of the peace, theft, assault with a weapon, assault causing bodily harm, trafficking cocaine, domestic disputes, possession ofweapons, uttering threats and pointing a firearm. Between July 17 and September 18,2014 there were 364 calls to the police regarding the Park, resulting in 170 documented police incidents. Attached and marked as Exhibit to this my Affidavit is a true copy list of police calls involving the Park from July 17 to September 18, 2014. Attached and marked as Exhibit to this my Affidavit is atrue copy of a further list providing more detail of those calls. 2 #171448 Attached and marked as Exhibit to this my Affidavit is-a further list providing detailof the more serious police calls for the period from July 17 to August 5, 2014. 10. Recent police calls of particular concern include an incident where a male threatened a woman with a bat, a convicted sex offender was observed in the Park on playground equipment counting condoms, a fight occurred between campers where one used a golf club as a weapon, one camper threatened another using a knife, a male swung a pipe at another male, a Taser, shotgun shells and a home made device that appears to have been constructed to fire shotgun shells were seized from the Park and there is information. that evidence of a homicide in another jurisdiction may be secreted in a tent in the Park. 11. A continued concern is the prevalence of intelligence suggesting that known gang members, drug dealers, sex trade workers and sex offenders are residing in the Park. Further, a number of people have set up operations in the Park stripping and repainting what appear to be stolen bicycles. 12. What cannot be easily measured is the innumerable incidents VPD officers have prevented due to their presence. I have reports from a large number of officers indicating that they prevent violent confrontations on several occasions during their shift each day at the park and these interventions are not necessarily documented in a police report. 13. Oneof the difficulties that police have had in dealing with the encampment is that there is frequent tension and disagreement between different people and groups of people in the Park. While there has been an ?inner Circle? of core protestors, and an ?outer circle" of more disparate interests, there is little coherent leadership in the encampment. 14. The encampment continues? to grow and, as it does, tensions in the Park are increasing. The number of police related incidents; including public drunkenness, drug use, noise and fights have escalated. For example, more than?5?0% of the calls related to assaults have occurred in the period since August 27, 2014. Attached and marked as Exhibit to this my Affidavit is'a .chart showing the police calls to the Park between July 17 and September 18, 2014 broken down by date. #171448 15. In particular, in the last week or so the mood of the people in the Park appears to have shifted and become more hostile. Based on my review of the observations of- police officers that are recorded in our daily operation reports verily believe that the situation at the Park is close to ?boiling over. This is because officers have observed an increasing number of hostile people, people with objects such as sticks, planks, shovels and pick axes that Could be used as weapons, and more. people acting in a hostile and aggressive manner towards police. 16. For example on Sunday September 21St at approximately 5 a.m. a mentally disturbed man called 911 saying he was in ?kill mode" and was going to cut his head off or kill people at the Park. Police officers attended and found the caller standing at the centre of the Park and arrested him under the provisions of s. 28 of the Mental Health Act. He disclosed that he had not slept in days and had taken drugs. 17. Further, where previously the ?inner circle? appeared able to exert leadership over the campers and maintain some order, this now appears to have broken down. Police officers have reported to me that they have witnessed public shouting confrontations between individual members of the leadership to the degree that officers had to stand by to ensure that the verbal confrontation did not escalate to a physical fight. Based on these and other observations reported to me by these officers, verily believe that there is no cohesive or effective leadership group amongst the protestors. 18. As a result of this deterioration in the situation at the Park, have been advised by representatives of the Vancouver Fire Department that they do not feel comfortable attending to review the safety of the site without an increased police presence. I have also been advised by police officers that they do not feel that it is safe to attend the Park without back up. I am concerned that if the encampment remains at the Park there will, in the very near future, be a serious altercation between campers, or between campers and Police or Fire personnel, which will result in injury and the necessity to use force to ensure public safety. Given the large number of people currently at the Park this could be a very significant problem. 19. I am concerned about the safety of the campers at the Park. . The Park is notdesigned to accommodate the number of people that are there since there are no shower or laundry 4 #171448 facilities. Hygiene is a serious concern as well as the potential for disease transmission and infestation of pests such as bed bugs and rats which are clearly in evidence. I am also concerned that in addition to the obvious public. disorder and criminality that is occurring on a daily basis there is a real danger of an undetected drug overdose death occurring at the Park given the circumstances that are prevailing there. We had- an incident of this nature during the ?Occupy Vancouver? camp which claimed the life of a young woman. 20. In addition to the problems listed above, the public in the area surrounding the Park has complained on a regular basis about the encampment and the activities taking place there. Most of these complaints have been made informally to VPD officers who have been patrolling in the area. Some of the complaints have been more formal and have been received by telephone or e-mail. Attached and marked as Exhibit to this my. Affidavit is a chart showing some of the formal complaints made by the public since the encampment has been in place in the Park. 21. The encampment is a drain on VPD resources and that drain is significantly increasing as the encampment continues and expands. The overtime cost for policing the Park between . July 19 and August 31, 2014 totals over $55,000. Attached and marked as Exhibit to this my Affidavit is a true copy of a chart and graph showing the cost of overtime incurred by VPD relating to incidents at the Park between those dates. The cost of overtime is now higher since further call outs have been conducted in September. 1 would estimate the cost to be reaching approximately $75,000 as of the date of swearing this affidavit. Police Actions: Police started off the shift by assisting fire in their daily countlofthe tents. Fire and police were careful not to touch or infringe upon the privacy of the tent dwellers. There were numerous people drinking in the park throughout the day. Eight pour outs. All people were cooperative and were warned would be enforced if the behavior continued. No repeat offenders. 2014 162431: File cleared no report. Minor disturbance between a male with obvious mental health issues picking verbal fights. The situation was a'ssuaged and the male sent on his way. a 2014 162482: File cleared report. With the safety issues and inherent danger of fire due to the dry air and congestion of the flammable tents fire was called to attend and extinguish the flames as well as give safety advice. Some even said that it should be torched to the ground as it's preventing from regular park goers from enjoying the City park. Many lecals approached PCs (approximately 10) voicing their frustrations with the occupiers of the park PC July 28th At 1930 Police received multiple complaints from neighbours in the area of Oppenheimer Park located at 400 Powell St, Van about loud drumming and chanting which had been going on through the afternoon and evening The residents in the area were frustrated about the noise and that nothing had been done about it. PC Fraser July 28th The general consensus around the park, of the people that approached police was they were wishing the tents would leave. Some of the people were calm and collected about their frustrations, while others, namely an elderly gentleman known only as ?cowboy? seem to be having a hard time holding back their anger.
